Sales Agreement

The following agreement is between Tamerlane Labradors (breeder), hereafter referred to as “Seller” and _______________________________, hereafter referred to as “Purchaser”.

In consideration of a purchase price of _______________ ($), of which no dollars ($0.00) is a nonrefundable deposit, the Seller transfers in fee simple all rights, privileges and responsibilities associated with AKC Limited Registration ownership of the female/male dog of the Labrador Retriever breed to Purchaser as of the date and time specified below.

Seller guarantees the dog specified above to be free of the following conditions for a period of thirty months (genetic and disease):

• Hip Dysplasia as rated by the OFA as Moderate or worse;
• Elbow Dysplasia as rated by the OFA as grade 2 or worse;
• Retinal Dysplasia as diagnosed by a ACVO veterinarian
• Hereditary Epilepsy as diagnosed by two different veterinarians (one of my choice).

In the event of any above conditions subsequent to the sale of the dog, Seller binds himself/herself to:

Refund the Purchaser the complete purchase price by the Seller if: 1) the genetic condition is sufficiently serious in the opinion of two qualified veterinarians, at least one of whom is selected by the Seller, to warrant euthanization of the dog.  2) the original purchase price of the dog was greater than or equal to $_________.

Purchaser has the right to return the dog to Seller during the 14 days from the date and time of signature of this agreement for a refund or the purchase price less the nonrefundable Surety of Action deposit portion on all local sales.  Local sales are defined as being within six hours by car between Seller’s and Purchaser’s residence.

Long-distance sales are defined as being beyond six hours by car.  In such cases, Purchaser has the right to return the dog to Seller within 14 days from the time and date of this agreement for credit in the amount of the purchase price toward the acquisition of another dog from Seller, or for a refund of the purchase price less the non-refundable Surety of Action deposit.

We the undersigned have read, understood and agree with the terms of this contract.
